PRESIDENTIAL DECREE

NO. 103 OF THE YEAR 2003

ON

THE AMENDMENT OF THE PRESIDENTIAL DECREE
NO. 18 OF THE YEAR 2003 ON VISA FREE FOR A SHORT VISIT
PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering : a.
That, in its development, the government of the Republic of Turkey has established a policy concerning the requirement of obtaining a visa to the citizens of the European Union countries, and other countries including Indonesian citizens, to enter the territory of the Republic of Turkey;
  b.

That the governments of the Republic of Indonesia and the Republic of Vietnam have agreed to establish a policy concerning free visa to the holders of an ordinary passport of the citizens of both countries on mutually beneficial and reciprocity basis that has been documented in the form of a bilateral agreement;

  c.
That for the requirement of obtaining a visa when entering the territory of the Republic of Turkey, thus the Republic of Turkey is not one of the countries that can be granted the Visa Free for a Short Visit, and on the contrary, as the government of the Republic of Vietnam has established the visa free policy, the Republic of Vietnam is listed as one of the countries that can be granted the Visa Free for a Short Visit;
  d.
That foreigners who have been granted the facility of Visa Free for a Short Visit are provided with a limited extension facility based on the particular reasons for extending their stay in the territory of the Republic of Indonesia;
  e.
That based on the consideration stated in a, b, c, and d above, it is deemed necessary to establish the Presidential Decree on the Amendment of the Presidential Decree No. 18 of the year 2003 on Visa Free for a Short Visit;
   
In View of : 1.
Article 4 Paragraph (1) of the 1945 Constitution;
  2.
Law No. 9 of the year 1992 on Immigration (State Gazette of the year 1992 No 33, Supplementary State Gazette No. 3474);
  3.
Government Regulation No. 32 of the year 1994 on Visas, Admission Permits, and Immigration Permits (State Gazette of the year 1994 No. 55, Supplementary State Gazette No. 3563);

IT IS HEREBY DECIDED:

To Establish :

   THE PRESIDENTIAL DECREE ON THE AMENDMENT OF THE PRESIDENTIAL DECREE NO. 18 OF THE YEAR 2003 ON VISA FREE FOR A SHORT VISIT
     
Article  I
  1.
Amending Article 3 of the Presidential Decree No. 18 of the year 2003 on Visa Free for a Short Visit by deleting Turkey in between the letters i and k and adding Vietnam, so that it wholly says.
     
" Article 3
     
 
Foreigners of the citizenships of particular countries as stated in Article 2 part (1) are the citizens of :
  a. Thailand;
  b. Malaysia;
  c. Singapore;
  d. Brunei Darussalam;
  e. Philippines;
  f. Hongkong Special Administration Region (Hongkong SAR);
  g. Macao Special Administration Region (Macao SAR);
  h. Chile;
  i. Marocco;
  j. Peru; and
  k. Vietnam."
     
  2.
Amending Article 5 of the Presidential Decree No. 18 of the year 2003 on Visa Free for a Short Visit, so that it wholly says:
" Article 5
  Free Visa for Short Visit as defined in Article 2 can be granted for 30 (thirty) days under the following conditions:
  (1). Visa Free for a Short Visit as referred to Article 2, can be issued for 30 (thirty) days.
  (2) In case of the occurrence of natural disasters, accidents or sickness, Visa Free for a Short Visit as referred to part (1), can be extended after obtaining an endorsement of the Minister.
  (3) Visa Free for a Short Visit as referred to part (1) cannot be converted into any other types of Immigration Permit."
     

Article II

 

This Presidential Decree becomes effective on the date it is promulgated.
