THE AMENDMENT TO PRESIDENTIAL DECREE NO. 18/2003 ON

THE EXEMPTION FROM BRIEF VISIT VISA

THE PRESIDENT OF THE REPUBLIC OF INDONESIA ,

Considering:

a. that in its developments, the government of the Republic of Turkey has stipulated a policy on enforcement of provisions on the obligation to citizens of member countries of European Union, including Indonesian citizens that will enter the territory of the Republic of Turkey to have visa;

b. that the government of the Republic of Indonesia and the government of the Republic of Vietnam have agreed to stipulate policy on the exemption of citizens of both countries for visa of ordinary passport holders on the basis of reciprocal principles contained in a bilateral agreement;

c. that in connection with the obligation to have visa to enter the territory of the Republic of Turkey, the Republic of Turkey excludes from the countries securing the exemption of brief visit visa and conversely the Republic of Vietnam stipulates free visa policy so that the Republic of Vietnam includes into the countries , securing the exemption from brief visit visa;

d. that foreigners already securing the facilities of exemption from brief visit visa are given limited opportunity by extending the period of stay in the territory of the Republic of Indonesia on the basis of certain and reason and period;

e. that based on the considerations as meant in letters a, b, c and d, it is necessary to stipulate a presidential decree on the Amendment to Presidential Decree No. 18/2003 on the exemption from brief visit visa;


In view of:

1. Article 4 paragraph (1) of the Constitution of 1945;

2. Law No. 9/1992 on immigration affairs (Statute Book of 1992 No. 33, Supplement to Statute Book No. 3474);

3. Government Regulation No. 32/1994 on visa, enter permit and immigration permit (Statute Book of 1994 No. 55, Supplement to Statute Book No. 3563);

4. Presidential Decree No. 1.8/2003 on the exemption from brief visit visa;



DECIDES:



To stipulate:

THE PRESIDENTIAL DECREE ON THE AMENDEMENT TO PRESIDENTIAL DECREE NO. 18/2003 ON THE EXEMPTION FROM BRIEF VISIT VISA.

Article I

1. To amend the provision in Article 3 of Presidential Decree No. 18/2003 on the exemption from brief visit visa by erasing Turkey between letters i and k and supplementing Vietnam so that the article entirely reads as follows:

Article 3

Foreigners being citizens. of the certain countries as meant in Article 2 paragraph (1) shall be citizens of countries:

a. Thailand;
b. Malaysia;
c. Singapore;
d. Brunei Darussalam;
e. The Philippines;
f. Hong Kong Special Administration Region (Hong Kong SAR);
g. Macao Special Administration Region (Macao SAR);
h. Chile;
i. Morocco;
j. Peru; and
k. Vietnam.

2. To amend the provision in Article 5 of Presidential Decree No. 18/2003 on the exemption from brief visit visa so as to entirely read as follows:

Article 5

(1) The exemption from brief visit visa as meant in Article 5 can be granted in 30 (thirty) days.

(2) In the case of natural disaster, accident or disease, the exemption from the brief visit visa s meant in paragraph (1) can be extended after securing approval from the minister.

(3) Status of the exemption from brief visit visa as meant in paragraph (1) cannot be changed into other immigration permit.

Article II

The presidential decree shall come into force as from the date of stipulation.
